Terms of service

Last updated: 13 October 2026

These terms are an agreement between Leaftail Inc., which operates SortTheStack ("we", "us"), and the business or organisation that uses it ("you"). By creating an account or using the service, you accept them. If you accept them for an organisation, you confirm that you are authorised to bind it.

1. The service

SortTheStack reads job applications against the requirements you set for a job, and helps you decide which applicants to review first by showing a recommendation and the evidence behind it. It is a tool for businesses. You must be at least 18 to create an account.

The service assists your decisions; it does not make them. AI assessments can be wrong or incomplete: a resume can be misread, evidence missed, and a recommendation mistaken. You are responsible for reviewing the results and for every hiring decision you make, including whom to contact, interview, set aside or hire. We do not claim the service predicts how anyone will perform in a job, or that it removes bias.

We may change, improve or remove features over time. If we remove something central to a plan you pay for, we will tell you in advance.

2. Your account

  • Keep your sign-in details secure, and tell us promptly if you think your account has been misused.
  • You are responsible for what happens in your account, including what your team members do.
  • Give us accurate account and billing information, and keep it up to date.

3. Your responsibilities as an employer

You are responsible for using the service lawfully. In particular, you agree:

  • to comply with the employment, human rights, anti-discrimination and privacy laws that apply to your hiring, including any requirement to tell applicants that AI is used to screen them, and to keep hiring records for a minimum period;
  • that you have the right to give us the applications you upload or collect, and that you have told applicants what they need to know about how their information is used, including by us as your service provider;
  • not to set requirements, knockout rules or screening questions that discriminate on grounds the law protects, such as age, sex, race, religion or disability, unless the law allows it for the job;
  • to post only real jobs that you are actually hiring for, and not to use the service to collect personal information under false pretences.

4. Acceptable use

You must not:

  • break the law, or help anyone else to, using the service;
  • upload malware, or content you have no right to share;
  • try to get into another customer's data, test or bypass our security without written permission, or disrupt the service;
  • scrape, copy, resell or reverse engineer the service, or use it to build a competing product;
  • use the service to make decisions about people other than in hiring for your own organisation.

5. Your data

You own the data you put into the service, including applications, and the results the service produces from it. You give us permission to store, process and transmit it only as needed to provide, secure and support the service for you, and as our privacy policy describes. We do not sell it, show it to other customers, or use applicant information to train AI models.

The account owner can export the account's data, or ask us to delete the account, from within the application. When an account is deleted, we delete its data as the privacy policy describes, except records we must keep by law, such as billing records.

If you send us feedback or suggestions, we may use them without owing you anything.

6. Our service and intellectual property

We own SortTheStack, including the software, design and content we provide. These terms give you the right to use the service while your account is in good standing; they do not transfer any ownership to you.

7. Plans, billing and cancellation

  • Plans, prices and limits are as described on our pricing page when you buy. Payments are processed by Stripe.
  • Subscriptions renew monthly and are charged in advance until you cancel. You can cancel at any time through the billing portal; you keep your plan until the end of the period you have paid for, and we do not refund partial periods unless the law requires it.
  • Prices do not include taxes, which are added where applicable.
  • If a payment fails, your account moves to reduced limits until the payment succeeds. Nothing is deleted because a payment failed.
  • We may change prices. We will tell you at least 30 days before a change applies to your subscription, and you can cancel before then.

8. Suspension and termination

You can stop using the service and close your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, puts other customers or applicants at risk, or is used unlawfully. Where it is reasonable, we will warn you first and give you a chance to fix the problem and export your data.

9. Disclaimers

We work to keep the service reliable and accurate, but it is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, including that the service will be uninterrupted or error-free, that its assessments will be correct, or that it is suitable for any particular purpose.

10. Limitation of liability

To the extent the law allows:

  • neither of us is liable to the other for indirect or consequential losses, or for lost profits, revenue, data or goodwill;
  • we are not liable for your hiring decisions, or for claims by applicants or others arising from them;
  • our total liability to you for all claims related to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or CAD $100 if that is more.

11. Indemnity

You will compensate us for claims, losses and costs (including reasonable legal fees) brought against us by third parties, including applicants, arising from your hiring decisions, the data you provide, or your breach of these terms or the law.

12. Changes to these terms

We may update these terms. We will change the date at the top of this page, and tell account owners about significant changes by email or in the application at least 30 days before they take effect. If you keep using the service after that, the updated terms apply.

13. General

  • These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute.
  • Neither of us is responsible for delays caused by events beyond reasonable control, such as an outage at a provider we depend on.
  • We may transfer these terms to a successor if the business is sold or reorganised. You may not transfer them without our written consent.
  • If any part of these terms is found unenforceable, the rest still applies. Not enforcing a part of these terms does not waive our right to enforce it later.
  • These terms, together with the privacy policy and any order or plan you buy, are the whole agreement between us about the service.
